All pets shall be restrained while in the Park. In particular, all dogs and cats shall either be kenneled (dog runs) or fenced. This containment must be completed by Tenants immediately after occupancy and first approved by Landlord. Landlord reserves the right to prohibit pets completely or prohibit pets in designated areas of the Park. No pets are allowed on the playground. No more than two (2) pets per household will be allowed. Pets are not permitted to be unattended in the park and/or create any nuisance. No vicious breeds of dogs are allowed on the premises at any time, specifically to include, but not limited to Rottweiler, Chow, Pit Bull, Bull Terrier, American Staffordshire Terrier, German Shepherd, Doberman Pinscher, Wolf, Wolf-Hybrids, etc., or any mixed breed including one of these breeds in its lineage, and/or dogs with a history of biting a human being.


Tenants are liable for all damages caused by Tenants’ children or the children of Tenants’ guests. An adult must supervise young children at all times. No unaccompanied children under age 5 will be allowed on the playground. The playground is closed between 10:00 p.m. and 8:00 a.m.


Dangerous instrumentalities including, but not limited to, weapons of all types, pellet and BB guns, slingshots, bows and arrows and similar items shall not be used within the Park. Explosives of all kinds, including fireworks, shall not be permitted or used within the Park. Tenants agree to hold Valdez MHP LLC and the Park, and their respective agents and employees harmless from and against any and all claims for personal injuries or damages caused by Tenants, Tenants’ families, guests or personal property.


Tenants shall observe normal courtesy in the use of entertainment devices, such as record players, radios or televisions, and avoid excessively loud speaking or shouting. Tenants shall not use loud speakers, spot lights or other items likely to cause disturbances in the Park. Tenants shall not engage in any activity that unreasonably disturbs or interferes with other tenants’ quiet enjoyment of their Premises or the Park.


The feeding of wild animals and or wild birds is prohibited within the Park. Tenants shall avoid wild animal problems by not providing any temptation for the wild animals to approach the Park. Tenants are not permitted to place fishing equipment, rubber boots, rain gear or similar items on porches or against the side of mobile homes. Waste from cleaning fish must be immediately removed from living areas and not left in garbage cans or back yards. Barbecue grills, smokers or similar items must be covered and locked up when not in use. All dog food must be kept within Tenant’s mobile home. All garbage must be tightly wrapped and stored in a container with a secure lid.


Parking for no more than 2 vehicles, neither being larger than a standard one-ton truck, is authorized on any Premises. Such vehicles shall be parked only in assigned parking areas. Two snow machines or motor-cycles or one of each will be allowed to be stored at or on the Premises. All other vehicles, including but not limited to, travel trailers, campers, boats, trailers, trucks and automobiles will not be permitted to be stored within the Park except in areas designated by Park management. The speed limit in the Park is 15 miles per hour. Repeated violations are grounds for eviction.


No open fires shall be permitted at any time or place within the Park. No fires shall be left unattended at any time. Tenants are encouraged to install smoke detectors and locate appropriate fire extinguishers at convenient locations within their mobile home. For the benefit of all Tenants, the Park strives to remove the snow as soon as possible. The large amount of snowfall in Valdez requires the cooperation of all Tenants. Tenants should not park vehicles in the street in such a way as to obstruct snow removal efforts. The Park will remove snow from driveways at a Tenants’ Premises for a fee per request.


All Premises shall be maintained to the highest possible standards in a clean and orderly manner and landscaped with grass in a clean, weed-free, watered and mowed condition. Tenants who allow their space to degenerate below such standard set forth herein may be notified in writing by Landlord that if such identified deficiencies are not corrected within 5 days after receipt of such written notice by Tenant, Landlord or its agent may, but is not obligated to, enter the Premises for the purpose of correcting such deficiencies, and Tenants shall pay to Landlord as additional Rent the cost of such services at the rate of $65 per man hour plus parts and equipment.


The planting of trees, shrubs and flowers is encouraged, subject to Landlord’s prior approval. No trees or shrubs shall be planted by Tenant in such a way as to obstruct the removal of any mobile home. No fences shall be installed without Landlord's express prior written approval. No heavy equipment is allowed in the Park without prior written approval from the Landlord. Heavy equipment will not be stored or parked in the Park except for that equipment which is owned or utilized by the Park for maintenance. This applies also to large trucks, tractor-trailers and similar vehicles.


No windbreaks, fences, storage buildings, trellises, additions to a mobile home or similar devices shall be installed without Landlord's express prior written approval. Prior to construction, the following items shall be submitted for Landlord's approval: a building plan, a plot plan and a complete description of the exterior of the accessory structure. Any structure built without Landlord's approval or not in compliance with the Valdez Mobile Home Park Rules and/or City of Valdez Ordinances may be required by Landlord to be torn down at Tenants’ expense. Failure to do so may be grounds for eviction from the Park.
